Bar Council of Bhutan

Justice being the primary source of peace in the Kingdom of Bhutan and reaffirming the noble goal in pursuit of justice and recognizing the importance of the assistance of a Jabmi to protect and establish rights in all stages of judicial/legal proceedings, the Jabmi Act was adopted by the Parliament in the year 2003. It is a comprehensive Act that covers all important provisions meeting international standards pursuant to which, the Bar Council of Bhutan is constituted for the first time as per the Jabmi Amendment Act 2016, with Her Royal Highness Princess Sonam Dechan Wangchuck as the President. The President of the Bar Council, Her Royal Highness Princess Sonam Dechan Wangchuck graced the inaugural ceremony on 10th May 2017.

Goal and Objective

The formation of the Bar Council and Bar Association will bring social harmony. People can make best use of the services of Jabmis for protecting their rights and getting justice at the end of every case. Based on the advice of Jabmis, an individual can decide whether to file a case before the court or not. Sometimes some of the cases could be resolved through negotiation by using the professional legal services of the Jabmis, which is reasonable, practical and beneficial for both the parties. Such practice will save time, money and efforts, and save family and social ties from breaking up which will ultimately contribute towards the aim of Gross National Happiness and promote social well-being.

The Bar Council will also promote pro bono or free legal services to the people who cannot afford to hire a Jabmi. For the rest of the society, it will organize legal aid services by using the expertise of the Jabmis. When civil cases are resolved through negotiation, it will ease the workload of the courts and judges will be able to focus more on the criminal cases, which is important for every accused, who are presumed to be innocent until proven guilty. When the criminals get justice it will reduce the number of crimes, which will promote social security.
